Jazz Pharmaceuticals, maker of the so-called date rape drug GHB has filed a request with the Securities and Exchange Commission to sell $180 million in stock. Jazz sells the drug as Xyrem. GHB is a Schedule I drug, which means it is in the same category as heroine
and considered extremely dangerous. It is approved for treating narcolepsy (extreme daytime sleepiness) but it is often prescribed for people suffering from chronic fatigue. It has serious risks, including coma and death. The 120,000 narcolepsy patients prescribed the drug generated only $29 million in sales in 2006, and the company sustained losses of $82 million in 2006. Most likely, Jazz is banking on increased prescriptions for “off-label” use, such as what happened with OxyContin and growth hormone. The law allows physicians to prescribe drugs for any condition they want, but drug companies can only advertise drugs for FDA-approved indications. Jazz is currently under indictment for violating FDA rules on drug promotion. It is hoping to increase the drug’s appeal by getting it approved by the FDA to treat fibromyalgia. That would open the floodgates because anyone with sore joints and fatigue can claim they have the disease. (The New York Times, May 31, 2007)
